Court: Red Bulls must pay $2.8M in property tax

A New Jersey appeals court ruled Monday that the state's Major League Soccer franchise is liable for nearly $3 million in property taxes to the town of Harrison.
The New York Red Bulls have played at Red Bull Arena in Harrison since 2010. During that time, the town billed the team for about $1.5 million for the 2010 tax year and about $1.3 million for 2011, according to court documents.
The team has paid the taxes, according to a team spokesman, but had filed a lawsuit to have them reimbursed.
In the lawsuit, the Red Bulls claimed they are exempt from paying taxes under state law because the property and stadium are devoted to "an essential public purpose."
The Red Bulls have the rights to all revenues from the stadium including naming rights, while the town and the Harrison Redevelopment Agency are allowed to use the stadium for events such as high school or college sports championships or public ceremonies.
Monday's appellate ruling held that while those other uses benefit the public, they are subordinate to the Red Bulls' uses of the stadium and therefore don't qualify the stadium for exemption under state law. |

Investors to Supreme Court: Deny Argentine do-over

Argentina's opponents have filed their last arguments with the U.S. Supreme Court, urging justices to deny the South American government's appeal of a $1.4 billion debt ruling because President Cristina Fernandez has repeatedly vowed not to honor any ruling that goes against her.
Argentina wants the court to overturn a ruling it says would provoke a catastrophic default by forcing it to pay $1.4 billion in cash to the investors it calls "vulture funds." These investors, led by billionaire Paul Singer's NML Capital Ltd., snapped up Argentina's defaulted debt when its economy crashed a decade ago and have litigated ever since, seeking payment in full plus interest even after 92 percent of other bondholders agreed to provide generous debt relief in exchange for regular payments on new bonds.
"Argentina already has made clear that it will not obey any adverse decision on the questions it presents," reads NML's brief, filed just before Wednesday night's deadline.
"Argentina ultimately is not interested in any court's views concerning those questions. By Argentina's lights, it has the final word, and it will recognize a judicial ruling only if it accords with Argentina's conclusions," NML said.
The "Aurelius Respondents," another group of hedge funds and holding companies based in the Cayman Islands and the US state of Delaware to avoid scrutiny and taxes, also filed a brief, urging the justices to deny Argentina's "do-over" request. "A chorus of disinterested parties has recognized that Argentina is without peer in its mistreatment of private-sector creditors," their brief said. |

Court revives victim lawsuit in mistaken shooting

The Supreme Court has reinstated the lawsuit filed by a former major league baseball player's son who was shot on the porch of his family home by a Houston-area police officer.
The justices on Monday ordered a lower court to reconsider the case of Robert Tolan, son of former major leaguer Bobby Tolan. The son was shot in the chest after police mistakenly believed he was armed and had stolen a vehicle.
A Houston-area jury acquitted Bellaire police Sgt. Jeffrey Cotton of criminal charges in the shooting, which happened on New Year's Eve in 2008. A federal appeals court dismissed Tolan's civil lawsuit claiming that Cotton used excessive force.
The high court said the 5th U.S. Circuit Court of Appeals acted too hastily. |

Court says final 'No' to Jewish restitution claim

The Czech Republic's highest court has confirmed the rejection of a restitution claim by the descendants of a Jewish man who owned a snap button factory that was taken over by the Nazis and then nationalized.
The Constitutional Court confirmed its 2010 verdict, which overturned a 2009 Supreme Court ruling and all previous rulings of lower courts that found in favor of three relatives of Zikmund Waldes, who owned the Koh-i-noor factory in Prague when the Nazis seized it in 1939 during their occupation of what was then Czechoslovakia. The heirs will also not get back a collection of some 20 paintings that were housed in the plant.
The latest verdict sent to The Associated Press by the court on Friday is final. It said the legal complaint by the heirs was "clearly baseless" because it didn't contain any new arguments. |
